France has copyrighted the light design on the Eiffel Tower (which is more recent than the tower itself) and there is no freedom of panorama in the country. Crisco 1492 (talk) 11:08, 26 February 2013 (UTC)[reply]

See [1] Sorry the link is in french, but basically, the case law says that the lighting during a spectacle was protected, not that the usual lighting is protected. Esby (talk) 13:41, 26 February 2013 (UTC)[reply]
  • That's interesting, although I didn't see any links to on-Commons discussions... and "The lighted image of the Eiffel Tower is registered in France at the "INPI" under the number 1379547 from March 26th 1996, ... [the images] cannot be reproduced without our authorization." suggests to me that it's not CC compatible. Does Luc have any cases which have been through the court to look at?Crisco 1492 (talk) 22:38, 26 February 2013 (UTC)[reply]
the INPI is the french patent office. Basically, the patent covers the technical aspect of the lighting, meaning you cannot reproduce this lighting in your garden, it does not mean you can't photography it or paint it. Esby (talk) 10:20, 27 February 2013 (UTC)[reply]
"cannot be reproduced without our authorization." It's the same as usual: an attempt to pretend to have rights that don't exist. Same like a museum forbids you from publishing a photograph of a PD-Old painting. Esby (talk) 10:22, 27 February 2013 (UTC)[reply]
